In a significant change to Maryland’s criminal record laws, the legislature has passed a measure allowing certain DUI and DWI charges to be expunged — a first for the state.

Under the new law, if you received probation before judgment (PBJ) for driving under the influence (DUI) of alcohol or driving while impaired (DWI) by alcohol, you may now request expungement 15 years after your discharge from probation.

Important Limitations

Not everyone will qualify. You are not eligible for expungement if:

  1. You have been convicted of another crime during the 15-year waiting period (excluding minor traffic violations or offenses that are no longer crimes), or
  2. You received PBJ for a subsequent DUI or DWI during those 15 years.

Why This Matters

For many Maryland residents, a DUI or DWI record can limit employment, housing, and other opportunities. This new law provides a long-awaited path to a clean slate but only for those who meet the strict eligibility criteria.
